    Terms of Service

    Agreement to Terms

These Terms of Service ("Terms") govern your use of this website and your request for a walkthrough or a proposal from Revived, the trading name of Tesseract Management, LLC ("Revived," "we," "us," or "our"). Our website is https://sellrevived.com.

These Terms are not your consignment agreement. If you go ahead with us, you sign a separate written agreement that sets out the pieces, the prices, the floors, the commission and how you are paid. That signed agreement governs the work, and where anything on this page conflicts with it, the signed agreement controls.

By requesting a walkthrough, booking a service, or using this website, you agree to be bound by these Terms. If you do not agree to them, please do not use our services.

    What We Do

Revived provides two services in PA, DE, MD & NJ:

    • In-home consignment: we photograph your pieces where they sit, research and price each one against completed sales of comparable pieces, list them, handle every buyer inquiry and negotiation, and pay you as they sell.
    • Estate sales: pricing, staging, advertising, staffing and settlement of an on-site sale.

We do not haul, remove, clear out or move anything as a service. Revived began as a furniture removal company and no longer operates that way.

Your pieces stay yours. Title to every piece remains with you at all times. Nothing leaves your home until it has been sold and paid for in full. We never take ownership of your property and we never take it to a warehouse.

    Where Your Pieces Are Sold

We list each piece on the channels best suited to it. In practice that means online marketplaces including eBay and Facebook Marketplace, our own buyer lists, and, for a piece that needs one, a specialist channel. Which channel a piece goes to is our judgment and we will tell you where each one is listed.

Buyers who come to the house attend by appointment only, at a time agreed with you, while you or someone you authorize is present. The buyer brings their own labor and equipment, does any disassembly, and takes the piece away. They pay you directly, before the piece is released.

Pieces that ship go one of three ways, whichever suits the piece: we pack and ship it, the buyer sends their own shipper, or you ship it with a label we buy. Postage and our packing labor are ours. Only the box and wrap used on that shipment, and the shipping insurance and signature on delivery when a piece needs them, come off before your share is calculated, so you and Revived each carry your own percentage of them. Each is itemized on your statement. Where a buyer asks for delivery on a local piece, we may arrange it; that delivery fee is separate from the sale price and does not come out of your share.

    The Walkthrough and the Proposal

The walkthrough, the research and the proposal are free, and they are yours whether or not you go ahead with us. There is no fee to sign and no charge for anything that does not sell.

Estimates are our opinion, not an appraisal. Every figure in a proposal is our informed opinion of what a piece should achieve on consignment, derived from recent completed sales of comparable pieces. It is not prepared to USPAP standards and must not be relied on for probate, insurance, taxation or any legal proceeding. It is not a promise of what any piece will sell for. Where we think a piece needs a credentialed appraiser or an auction house, we will tell you before it is listed.

    Our Commission

Our commission is a percentage of the final sale price of each piece that sells, set by the total estimated value in your proposal and fixed for the term:

    • 50% where the total estimate is under $5,000
    • 40% from $5,000 to $19,999
    • 35% at $20,000 and above

Marketplace and payment processing fees are taken off the sale price before the commission is worked out. Nothing is payable when you sign, and nothing is payable on a piece that does not sell. Our minimum engagement is roughly $500 of estimated resale value. Current details are on our in-home consignment page.

Where a piece sells for more than its stated estimate, the whole of that excess is yours and we take no commission on it.

Add-ons. Work outside the agreement, such as cleaning, repair, disposal, delivery arranged for you rather than for a buyer, or removing pieces that do not sell, is chargeable only where you have agreed to it in writing, which includes a text message, and only at the rate agreed. Any such charge appears on your next statement.

How and When You Are Paid

You are paid first. The order is always the same:

    • Sold at your home: the buyer pays you directly, before the piece leaves, in cash or any method you choose to accept. We invoice our commission on that piece afterwards, on your statement.
    • Sold on a marketplace: the buyer pays the marketplace, the marketplace sends the proceeds to us, and we send you your share every Friday for every sale whose funds reached our account by the preceding Thursday.

Marketplaces do not release money immediately. They typically hold a payment until the buyer has received the piece, so funds usually reach us some days after the sale and a sale made in one week is normally settled on a later Friday. We do not hold money that has reached our account past the next Friday.

We pay every Friday, by check, or by transfer to your own bank account if you link it through Stripe in your client portal. Your account details go to Stripe, not to us, and we never see or hold your bank numbers.

Every Friday you get one itemized statement, by text and email, showing for each piece sold: the sale price, the channel, any marketplace fee, the box and wrap, any shipping insurance and signature fee, our commission, what is due to you and the date it was paid. The same figures are live in your portal.

    What We Guarantee

We guarantee four things, and each one is an act by us rather than a result in the market:

    • One person from Revived attends your home.
    • No piece leaves your home until it has been sold and paid for.
    • You are paid by the buyer at the door for a piece sold at your home, and by us every Friday for a piece sold through a marketplace, against an itemized statement.
    • Every buyer visit is scheduled with you in advance and happens only with your agreement.

We do not guarantee that any piece will sell, or the price it will sell for. Full wording is on our Guarantees page and in your signed agreement.

Prices, Floors and Withdrawing a Piece

Each piece carries an estimated range and a floor price that you approve when you sign. We list at or above the top of the range, may reduce the listed price over the term on the schedule we disclose to you, and may accept any offer at or above the floor without asking again. No piece is ever sold below its floor without your consent by text or email.

You may withdraw any piece at any time before it sells, by text. If a piece is withdrawn after a buyer has already paid, you are responsible for that buyer's refund and for any marketplace fee that cannot be recovered.

    What Does Not Sell

The term is sixty (60) days and can be extended by text. At the end of it you choose: keep the term running, keep the unsold pieces, donate them against a receipt, or have us remove them at a quoted cost. Nothing is removed, donated or disposed of without your instruction.

Your Home, Your Insurance, and Damage

Every piece stays at your home and within the cover of your own property insurance until a buyer takes possession, or until we take a sold piece to ship it, when it becomes our responsibility. We will make good, up to the estimated value stated in your agreement, any damage we or a buyer cause during a visit we arranged. Wear that was there when we photographed a piece is described in the listing and is not repaired.

Revived carries commercial general liability insurance of $1,000,000 each occurrence through National Specialty Insurance Company. A certificate is available on request and you may be named as an additional insured for the term.

Buyers attend by appointment only, while you or someone you authorize is present. You agree to hold us harmless for injury to a buyer or other visitor at your home, and for damage a visitor causes, except where it was caused by our own negligence. Those matters fall to your property insurance and to the visitor.

If Something Is Lost or Broken in Shipping

Every piece we ship that sold for more than $100 is insured for what it sold for. We pack it in a new box, photograph it packed, and buy the insurance on the label. Anything that sold for $750 or more we pack ourselves and send with a signature on delivery. The insurance and the signature fee come off the sale before the split, the same as the box, so you and Revived each carry your own percentage of them.

If the carrier loses or breaks a piece, we handle the buyer, file the claim and chase it. You get your normal share of the claim money on the Friday after it reaches us, and we tell you within two business days of hearing about it. If our packing caused it, or we missed a step on our side, such as not buying the insurance or filing late, we pay your share ourselves.

If a claim is ever turned down for a reason nobody could control, the piece counts as unsold. We take no commission on it and charge you no costs for it. Pieces worth more than $5,000 never go in a box on a truck. They go by fine art or freight shipper, by the buyer's own shipper, or to a buyer who comes to your door.

    Honesty and Authority

You confirm that you own each listed piece or are otherwise authorized to sell it, that no further consent is needed, and that no lien, claim or dispute affects any of it. You also agree to tell us about any documentation, maker, provenance or fault you know of that affects what a piece is worth.

We confirm that we will describe every piece accurately to buyers, will not overstate its condition or provenance, and will tell you where we think a piece is not worth listing.

While a piece is listed with us, you agree not to offer that same piece through another person, agent or marketplace. If you sell one yourself, it comes off the list that day and is reconciled on your next statement, net of any cost we have already spent on it.

    Booking and Scheduling

Appointments: walkthroughs and buyer visits are scheduled with you. We give you a time and make reasonable efforts to keep to it.

Confirmation: you receive confirmation by SMS or email. By giving us your phone number you consent to service-related text messages.

Cancellation: you may cancel or reschedule at no charge with at least 24 hours' notice. We may reschedule for severe weather or a safety concern and will do so at your earliest convenience.

    SMS Communications Consent

By submitting a form on our website, calling or texting our business number, or providing your phone number during service, you agree to receive SMS messages from Revived regarding:

    • Appointment confirmations and reminders
    • Day-of arrival notices
    • Proposal and agreement links
    • Buyer visit times and offers
    • Your Friday statement
    • Review requests

    Photographs and Recording

We use the photographs we take of your pieces to sell them. We may also use those photographs as examples of our work, with your name and your address removed.

We may record a visit or a call, and take short video clips, so we can describe pieces accurately to buyers and improve our work, but only where you have agreed in advance in writing, which includes a text message. You can withdraw that at any time by text and we stop. Nothing recorded is published showing your name, your face or your address without your separate written permission, and we do not record anyone else at your home, including a buyer, without their consent.

    Ending the Engagement

Either of us may end the agreement on seven (7) days' notice by text or email. Pieces already sold settle in the ordinary way and everything still listed is withdrawn from sale.

    Limitation of Liability

To the maximum extent permitted by law:

    • Our total liability under an engagement shall not exceed the commission we have received on the pieces sold.
    • We are not liable for indirect, incidental, special, consequential or punitive damages.
    • We are not liable for the price a piece achieves, or for a piece not selling.
    • Damage we or a buyer cause is handled under the clause above, capped at the estimated value stated in your agreement.
    • Our promises on shipping loss and damage, above, are not limited by this cap.

    Indemnification

You agree to indemnify and hold harmless Revived, its members, employees and agents from claims, damages, losses or expenses (including reasonable attorney's fees) arising from:

    • Your breach of these Terms or of your signed agreement
    • Your misrepresentation of the ownership, authority, condition or provenance of a piece
    • Injury to a buyer or other visitor at your home, or damage a visitor causes, except where caused by our negligence
    • Any third-party claim relating to a piece you listed with us
